A residence permit can be linked to a marriage, so that you would lose it if you separated. If there is violence in the marriage, this is a very difficult situation. That is why there is a special provision in the law.

Hardship case for domestic violence

The Foreign Nationals and Integration Act (FNIA) regulates the residence of migrants in Switzerland. If a couple separates while one person is still dependent on the residence status of the marriage, this can be difficult. There are special protection provisions for people who experience domestic violence.

A so-called hardship case (Art. 50b AIG) is possible. The residence permit may remain valid in the event of important personal reasons, such as domestic violence. 

Evidence must be available to show that a person has been the victim of violence. This can be, for example, reports from counseling centers or doctors.
